BAF Verification

BAF Verified Badge Licence Terms

These terms govern use of the BAF Verified badges, badge artwork and BAF verification IDs owned by Buy Australian First Pty Ltd (BAF). They apply in addition to the BAF Verification Standard & Terms.

1. Limited licence

When BAF grants a current verification, BAF gives the approved business a limited, non-exclusive, non-transferable and non-sublicensable licence to use the specific BAF badge issued for the approved status and scope during the verification period.

The business does not acquire ownership of the badge, BAF name, BAF logo or verification system.

2. Use only for the approved status

The badge may only be used for the legal entity, trading business, product, product range or other scope that BAF approved. A business must not use a badge in a way that creates a broader Australian ownership or manufacturing claim than the approved BAF record supports.

In particular, a BAF Australian Made badge must not be positioned or described in a way that implies every product sold by the business is Australian made when only specified products or ranges have been approved.

3. Approved artwork and BAF ID

Businesses must use the current badge artwork supplied or made available by BAF. The badge and associated BAF ID must remain legible and must not be separated, substituted or altered in a way that could mislead consumers.

A business must not create its own BAF ID, reuse another business's ID or display an expired, suspended or revoked ID as current.

4. No alteration

Unless BAF gives written approval, a business must not:

  • change the wording, colours, proportions or elements of the badge;
  • remove or obscure the BAF ID;
  • combine the badge with another mark so that it appears to be one logo;
  • add words suggesting government endorsement or a broader certification;
  • use the badge as the business's own primary corporate logo;
  • use an obsolete badge version after BAF has required migration; or
  • sell, license, transfer or provide badge files to another business for use.

5. Websites, social media and advertising

A current badge may be used on the verified business's website, approved social media accounts and marketing material where the context accurately reflects the approved BAF status and scope.

If only selected products or product ranges are BAF Verified Australian Made, the badge should appear on the pages, advertisements or sections relating to those verified products. It must not be placed in a site-wide header, homepage banner, catalogue cover or other general position if that placement would create the impression that unverified or imported products are also covered.

A BAF verification badge must not be used as a social-media profile picture or account avatar in a way that makes the badge appear to be the business's own corporate identity or suggests that all activity of the business is certified.

Where all, or substantially all, products represented in a particular marketing context are covered by the relevant BAF status, broader corporate placement may be permitted where the overall impression remains accurate.

Where practicable, digital use should link to the relevant BAF verification record or provide the BAF ID so the public can check current status.

6. Packaging and labels

Use on product packaging, permanent labels or high-volume printed material must accurately match the verified product scope. BAF may require specific written approval before packaging use, particularly where a badge could reasonably be understood as applying to the product itself.

A business must not commence a new print run using an expired, suspended or revoked badge. Where existing printed stock is affected by a later status change, the business must contact BAF promptly so an appropriate corrective or run-out arrangement can be considered consistently with consumer law. BAF may require immediate cessation where continued use would be materially misleading.

7. Product and scope changes

A business must not extend badge use to a new product, new manufacturing source, materially changed formulation or new product range merely because another product is already verified. Where the change could affect the approved scope, the business must obtain BAF confirmation before using the badge for that item.

If BAF removes a product or product range from an approval, badge use for that removed scope must stop even if other products remain verified.

8. No government affiliation

The BAF Verified badge is an independent private verification mark. It must not be described or presented as a government logo, government approval or the Australian Made, Australian Grown certification trade mark.

9. Monitoring and correction

BAF may monitor public use of its badges and may ask a verified business to correct use that is inconsistent with these terms. The business must make a reasonable requested correction within the timeframe BAF specifies, taking into account the nature and seriousness of the issue.

10. Expiry, suspension and revocation

The licence automatically ends when the relevant verification expires, is suspended or is revoked. The business must stop representing itself as currently verified and must remove the badge from digital channels promptly and, in any event, no later than 5 business days after notice or expiry unless BAF confirms another timeframe in writing.

Physical materials must be dealt with in accordance with any reasonable BAF direction and applicable consumer law. No new material carrying the badge may be produced after the licence ends.

11. Misuse

Unauthorised use, copying, alteration or false representation of a BAF badge or BAF ID may result in removal from BAF services, suspension or revocation of verification, requests for corrective action and any legal remedies available to BAF.

12. Changes to badge artwork

BAF may update badge artwork for security, branding or legal reasons. BAF will give current verified businesses reasonable notice and migration instructions where a change requires replacement of existing digital artwork.

13. Consumer law

Nothing in this licence authorises misleading conduct. The badge must be used in a way that makes the overall impression of the business's advertising accurate, including any necessary qualification about the approved product scope.
