Terms of Use

These Terms of Use govern access to and use of the Buy Australian First website, directory, product directory and business account services operated by Buy Australian First Pty Ltd (BAF, we, us or our).

By using the website or creating an account, you agree to these terms. If you apply for BAF verification or use a BAF verification badge, additional terms apply and form part of your agreement with us.

1. About BAF

BAF operates a directory intended to help people discover businesses and products connected with Australia and a separate evidence-based verification program for approved Australian ownership and Australian-made claims.

A directory listing is not the same as BAF verification. A business is only BAF Verified when its public listing expressly shows a current BAF Verified status and, where applicable, a current BAF ID.

2. Directory listings

BAF may create and maintain unclaimed business listings using information supplied by businesses or obtained from public sources. An unclaimed or “Not Yet Verified” listing does not represent a BAF finding that the business meets any BAF ownership or manufacturing standard.

BAF may edit, correct, merge, re-categorise, deactivate or remove directory information where reasonably necessary to maintain accuracy, avoid duplication, respond to a valid request, protect users or comply with law.

3. Business accounts and listing claims

A business account is intended for an authorised representative of a business. You must provide accurate information, keep account credentials secure and notify BAF if you believe an account has been compromised.

Claiming a listing is currently free. Approval of a claim gives the approved account the ability to manage the relevant directory profile. It does not grant BAF verification, a verification badge or any ownership/manufacturing status.

You must not claim a business, submit changes or act for a business unless you have authority to do so.

4. Information and content you provide

You are responsible for ensuring that information you submit to BAF is accurate, current and not misleading, and that you have the right to provide it. You must not submit material that infringes another person’s rights or is unlawful, fraudulent, defamatory or malicious.

You retain ownership of content you own. You grant BAF a non-exclusive, royalty-free licence to host, reproduce, format and display content you provide to the extent reasonably necessary to operate, promote and maintain your BAF listing or service. You may request removal of optional content, subject to reasonable record-keeping and legal requirements.

5. BAF verification

BAF verification is a separate process governed by the BAF Verification Standard & Terms. Payment, advertising, featured placement or other commercial support does not determine whether an applicant satisfies BAF verification requirements.

BAF may require supporting documents, conduct checks, request clarification and reassess a verification if relevant circumstances change.

6. BAF marks, badges and intellectual property

The BAF name, logos, verification badges, badge artwork, BAF IDs, website design and original BAF material are owned by or licensed to Buy Australian First Pty Ltd and are protected by applicable intellectual-property laws.

A verified business receives only the limited permission described in the BAF Verified Badge Licence Terms. No person may copy, alter, imitate, sell, sublicense or use a BAF verification badge in a way that suggests verification where no current verification applies.

7. Product directory

The Australian products section is a directory and information service, not a BAF ecommerce store unless a page expressly says otherwise. Product names, images and descriptions may be supplied by businesses or drawn from public information. Purchases are generally made from the relevant third-party seller, whose own terms, returns and warranties apply.

A product appearing in the directory is not automatically BAF Verified as Australian Made. Any BAF verification status must be expressly shown and must be read together with its approved scope.

8. Acceptable use

You must not use BAF to:

  • impersonate another person or falsely claim authority for a business;
  • submit false, forged or misleading verification evidence;
  • scrape, overload, attack or interfere with the security of the platform;
  • attempt to access another user’s account or private verification material;
  • misuse a BAF ID or badge; or
  • use the platform for unlawful conduct.

9. Third-party websites and services

BAF listings may link to websites, maps, social media, payment services or other third-party services. BAF does not control those services and is not responsible for their content, availability, privacy practices or transactions. A link does not by itself mean BAF endorses the third party.

10. Accuracy and availability

We work to improve directory accuracy, but business information can change and public-source information can contain errors. BAF does not promise that every unverified listing, product description, location, opening status or third-party link will always be complete or current.

We may maintain, modify or temporarily suspend parts of the platform. We will use reasonable care but do not guarantee uninterrupted access.

11. Consumer law and liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

To the extent permitted by law, BAF is not responsible for indirect or consequential loss caused solely by reliance on an unverified directory entry, a third-party website, or conduct of a third-party business that BAF does not control. This does not limit liability where it would be unlawful or unfair to do so.

12. Suspension and termination

BAF may restrict or suspend an account where there are reasonable grounds to believe the account is unauthorised, compromised, fraudulent, being used to breach these terms or creating a material risk to BAF or other users. Where reasonable, we will explain the issue and provide an opportunity to respond.

Verification suspension and revocation are dealt with separately under the verification and badge terms.

13. Privacy

Our collection and handling of personal information is described in the BAF Privacy Policy.

14. Changes to these terms

We may update these terms to reflect changes to BAF services, law or security. Material changes affecting an existing paid service or current verification licence will be applied fairly and, where reasonably practicable, notified to affected users before they take effect.

15. Governing law

These terms are governed by the laws of South Australia and applicable laws of the Commonwealth of Australia. Courts with jurisdiction in South Australia may hear disputes, subject to any rights a person has to bring a matter elsewhere under applicable law.
